Terms of Services/Contract
These terms and conditions ("Terms", "Agreement") are an agreement between Shimmer Pro ("Service Provider", "we", "us", "our") and the customer ("Customer", "you", "your") accessing or using Shimmer Pro services ("Services"). This Agreement sets forth the general terms and conditions of your use of the Services provided by the Service Provider.
1. Services:
1.1. The Service Provider herein agrees to provide mobile boat detailing, brightwork restoration & finishing services and/or any other agreed upon Service to the Customer at the agreed-upon location, price, and date or rescheduled dates.
1.2. The Services provided may include, but are not limited to, washing, waxing, oxidation removal, polishing, interior cleaning, and other related boat detailing and/or brightwork services as agreed upon between the Customer and the Service Provider.
2. Appointment Scheduling:
2.1. The Customer agrees to schedule appointments for the Services in advance.
2.2. Changes to scheduled appointments must be communicated to the Service Provider at least 48 hours in advance.
3. Payment:
3.1. All services will require an upfront deposit of 40% of the net Service quotation in order to secure a place in line on the schedule and materials. Deposits are non-refundable, but service dates can be rescheduled. Outstanding payments for the Services provided shall be made in full at the completion of services unless otherwise agreed upon between the Customer and the Service Provider.
3.2. Payment methods accepted by the Service Provider include cash, EFT and credit card. The Customer agrees to pay for credit card fees, if any are applicable.
3.3. Any additional services requested by the Customer during the provision of Services may incur additional charges and an amendment to the net Service quotation will be made to reflect this.
3.4. The Customer understands that travel fees to and from the location of service will be included in the service quotation.
4. Cancellations and Refunds:
4.1. Cancellations or appointment rescheduling made by the Customer less than 48 hours before the scheduled appointment will result in a R1000.00 cancellation fee/rescheduling fee. The Service Provider reserves the right to reschedule Service dates at any point in time due to any unforeseen circumstances and will communicate the date changes to the Customer.
4.2. In severe weather, we may determine it is not safe to travel and/or carry equipment and supplies to your boat; therefore, your detailing service for that day will be cancelled. When this occurs, we will reschedule in writing via email, text, or phone call.
4.3. Services are non-refundable. If necessary, we will return to the site location to complete any service that was incomplete.
4.4 In the event that the Service provider determines they are unable to provide the agreed services on the agreed dates or any other agreeable date, the deposit shall be returned to the Customer in full.
4.5 The Customer understands that returned deposits may take up to 10 business days to fully reflect in their accounts.
5. Liability:
5.1. The Service Provider shall not be liable for any damages to the Customer's boat or property arising from the provision of Services, except in cases of willful misconduct or gross negligence.
5.2. The Customer acknowledges that the Service Provider shall not be liable for any damages resulting from pre-existing conditions or defects in the boat.
6. Customer Obligations:
6.1. The Customer agrees to provide access to the boat and necessary utilities (water, electricity) at the scheduled location and time for the provision of Services.
6.2. The Customer understands that there may be additional charges if we need to remove items prior to cleaning hatches, lockers, compartments, etc. Heavier items may result in a larger upcharge. To minimize the risk of loss or damage, we advise customers remove the clutter from compartments themselves.
7. Insurance:
7.1. The Service Provider shall maintain appropriate insurance coverage for liability and property damage arising from the provision of Services.
8. Confidentiality:
8.1. Both parties agree to keep confidential any proprietary or sensitive information disclosed during the provision of Services.
9. Governing Law:
9.1. This Agreement shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
10. Entire Agreement:
10.1. This Agreement constitutes the entire agreement between the parties regarding the subject matter herein and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral. By booking our Services, you agree to be bound by these Terms and Conditions. If you do not agree to abide by these Terms and Conditions, you may not use our Services. We reserve the right to update or modify these Terms and Conditions at any time without prior notice.
*This is a legally binding document. By signing this, I (Customer) agree to the terms and conditions of service, as listed above.
